Internet Laws You Need to Know: The Price of Technology

Governments and lawmakers worldwide are implementing new regulations and laws to address the potential risks and challenges associated with the advancements in technology. Some of the most critical changes in technology and internet laws include the HB142 bill, the STIR/SHAKEN caller ID authentication framework, the Digital Services Act, and the SEC’s updated cybersecurity regulations. Companies are also using online influencers to reach their target audience, but issues have surfaced with influencers posting misleading content and not disclosing sponsored posts. The ACCC in Australia is cracking down on this and requiring influencers to include crucial information about the products they promote online. The European Union’s Digital Services Act aims to provide more protection to online consumers and hold online platforms more accountable for their actions. As technology continues to advance, it is crucial to keep pace with these advancements by implementing new regulations and laws to ensure its safe and responsible use.

The Advancement of technology and the internet has revolutionized various industries, including businesses and consumers’ daily lives, granting them more freedom and flexibility. However, the freedom that technology provides often comes with a price. Technology has reduced barriers, leading to numerous issues such as cybercrime, addiction, and mental health problems. Governments and lawmakers worldwide have taken steps to address these problems by implementing new regulations and laws.

Technology and Internet Laws

Here are some of the most critical changes in technology and the internet that users should be aware of:

Technology and Internet Laws

Adult ID Certification

The HB142 bill came into effect in Louisiana in 2023. It demands that residents provide government-issued ID to access websites with adult material to reduce the harmful impact of such materials on minors, such as low self-esteem, body image disorders, and difficulties in forming positive relationships. Eleven other states in the US have proposed similar bills since Louisiana lawmakers passed HB142.

Caller ID

Robocalls and caller ID spoofing are significant problems in the United States. In 2019, Americans lost over $1 billion to phone scams using caller ID spoofing to disguise their identity to make phone calls appear to come from legitimate and trustworthy sources. The STIR/SHAKEN caller ID authentication framework was created in response to the spoofing problem, which the FTC dubbed an epidemic. This framework aims to reduce cases of illegal robocalls. It came into effect in June 2021 in the US and November 2021 in Canada. All telecommunication providers must use caller ID authentication under this framework.

Cybersecurity Management

The incidence of cybercrime has increased by 153% between 2017 and 2021, according to AAG IT Services. The SEC created the “Cybersecurity Risk Management, Strategy, Governance, and Incident Disclosure” to counter this trend. The cybersecurity regulation is a comprehensive framework that provides guidelines for public companies regarding their cybersecurity risk management and incident disclosure practices.

In conclusion, while technology and the internet offer users numerous benefits, they also have downsides that users need to be aware of. The changes in technology and internet laws highlight the need for individuals and organizations to take precautions to protect themselves and their data from potential harm.

The Securities and Exchange Commission (SEC) updated its cybersecurity regulations in March 2022. Public companies must now report material cybersecurity incidents and provide periodic updates on previous cases. The SEC also requires public companies to disclose information about the experience of their management and board of directors in handling cybersecurity risks and implementing new policies.

Influencer marketing has become a popular way for companies to reach their target audience by using online influencers. However, issues have surfaced with influencers posting misleading content and not disclosing sponsored posts. The Australian Competition and Consumer Commission (ACCC) started cracking down on this in early 2023, requiring influencers to include crucial information about the products they promote online. Failing to disclose this information goes against the ACCC’s core goal of consumer protection.

Data sharing is a growing concern among consumers as tech giants like Meta and Alphabet sell their personal information. The European Union rolled out the Digital Services Act to address these concerns. This act places more regulations on tech companies, restricts how they can sell user data, and aims to give online consumers more protection and hold online platforms more accountable for their actions.

Governments and lawmakers worldwide recognize that technology offers more good than bad, but specific changes need to be made to ensure that it is used to better the world. These changes have come in the form of different laws and regulations, such as the HB142 bill, the STIR/SHAKEN framework, and the Digital Services Act. While technology continues to advance, it is crucial to keep in mind the potential risks and challenges that come with it, and to ensure that the laws and regulations keep pace with these advancements.
