The court also called for the enforcement of stricter application of rules regarding intermediaries as notified in Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. Thakur emphasized that abusive language and uncivilized behavior in the name of creativity cannot be tolerated and that the government will not back down from making any necessary changes to the rules regarding this matter.
Complaints and Action Taken
Thakur addressed the process for addressing complaints on OTT platforms, stating that on level one, the producer is responsible for solving complaints and almost 90% of complaints are cleared at this stage. The next level is the association level, where almost everything is cleared. Finally, when complaints reach the government, strict action is taken. However, Thakur noted that complaints have increased in the last few days.
Recent Court Decision
On March 7, the Delhi High Court upheld an order for the registration of an FIR against the TVF and its actor and asked the government to take steps to check the language of the content on OTT platforms. The court clarified that the direction to register an FIR in the present case does not include a direction to arrest any of the accused/petitioners. The high court also asked the government to take steps to enforce the stricter application of its rules regarding intermediaries as notified in Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
Observations Made by the Court
In its judgement, the court drew attention to the situations that are fast emerging on a daily basis and called for the enforcement of stricter application of rules regarding intermediaries as notified in Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. The court emphasized that the power of obscenity and sexual explicitness of language used in web series cannot be undermined and has a definite effect of depraving and corrupting the minds of people, especially the impressionable minds. The court also stated that transmitting such content is subject to Article 19(2) of the Constitution of India and that the petitioners will be liable to face action under Section 67 and 67A of I.T. Act.
The court faced the task of striking a delicate balance between free speech and freedom of expression and transmitting to all without classification the content which is obscene, profane, lascivious, sexually explicit in spoken language as it conjures with the words ‘sexually explicit acts’.
